The Waseca County Board of Commissioners will hold the final public hearing on the comprehensive plan before they consider its adoption.  Written comments are welcome.  There will be a 30-day comment period following this public hearing.  There have been some additional changes to the draft maps since the public hearing of November 16, 2005.  The Comp Plan final draft will be available on the county website at http://www.co.waseca.mn.us/ and at www.rndc.org  For more information contact the Region IX Development Commission, Reggie Edwards, 1.800.450.5643, ext 872.

WASECA COUNTY BOARD OF COMMISSIONERS—MARCH 7, 2006

 

            The Waseca County Board of Commissioners met in regular session on Tuesday, March 7, 2006 in the Commissioner’s Room, East Annex Building, 300 N. State St., Waseca, MN.  The following members were present:  Rick Morris, Chairperson; Wendell Armstrong, Jim Peterson and Al Ruhland.  Richard Androli was absent. 

 

            Rick Morris, Chairperson, called the meeting to order at 9:00 a.m.  The Pledge of Allegiance was recited. 

 

            Also present was Bruce Boyce, Coordinator,  Joan Manthe, Auditor,  Deanna Bendix, News Reporter, and Paul Dressler, County Attorney.

 

            Peterson moved and Ruhland seconded the motion to approve the agenda as presented.  Motion carried unanimously. 

 

            The board shared their committee and meeting reports.

 

            Correspondence was passed to all commissioners.

 

             Peterson moved and Armstrong seconded the motion to approve the consent calendar as follows:

·        Minutes of February, 21, 2006.

·        Approval of the Auditor, Commissioner, Human Services and expense bills as presented.

·        Authorize chair to sign annual Boat and Water Safety Grant Agreement for fiscal year 2006 in amount of $2,800.00.

·        Personnel Status Changes

1.      Transfer Sheri Dardis from Auditor Technical Clerk to ½ time Office Support opening in Human Services effective 3-6-06 at pay range A13 step D $14.20/hr.

2.      Hire Ann Staloch as Financial worker in Human Services effective 3-27-06 at Pay range B32, 95% of step A $14.19/hr.

3.      Promote Hunter Janzen to Deputy from current Dispatch position effective 3-1-06 at Deputy pay range, step C, $3511/mo.  This creates a dispatcher vacancy.

The motion carried unanimously approving the consent agenda.

 

            The Auditor presented an update of the Dollar General Store to be built in the watershed area of County Ditch 44.  The commissioners had no objection to the construction.

 

            The Auditor presented a letter from Kurt Deter, Ditch Attorney, updating the county on the procedure for re-determination of benefits of County Ditch 18 and 44 and also on the abandonment procedure.  We are awaiting a petition from the City of Waseca before a hearing can be set.

 

            Marilee Reck, Human Services Director, presented the parental fee case study.  Armstrong moved and Peterson seconded the motion to approve the newly revised fee schedule for social services effective 4-1-06, as presented.  Motion carried unanimously. 

 

            Armstrong moved and Peterson seconded the motion to delay implementation of a fee for service on respite care until July 1, 2006, to allow time for notification and review of this change with families.  Motion carried unanimously. 

 

            Paul Dressler, County Attorney, has received notice from the Environmental Quality Board on the release of the ag covenant in order to proceed with the ethanol property condemnation.  Peterson moved and Armstrong seconded the motion to proceed with condemnation of the Trahms property in preparation of the ethanol plant.  Motion carried unanimously. 

 

            The board requested that Paul Dressler be present at the county board meetings.  Paul will plan to be present beginning two weeks from today.  If not available, he would be on call for legal advice during the Commissioner meeting.

 

            Bruce Boyce, Coordinator, updated the board on the draft letter of understanding for the conditions of leasing the Brattrud property received from the City of Waseca.  The city is requesting retail space in the proposed Human Services building as a stated condition from their cleanup and demolition grant.  The county requested a workable concept plan from the Waseca City Council before any further progress takes place.

 

            Angie Knish, Planning & Zoning Administrator, presented a request from Lincoln Outdoor Advertising for a six month extension on their zoning permit.    Armstrong moved and Ruhland seconded the motion to approve the extension to December 13, 2006, of the zoning permit to construct four billboards at the Crystal Valley Coop site in Section 5, St. Mary Township.    Motion carried unanimously. 

 

            Ruhland moved and Peterson seconded the motion to approve the final plat RBK 2, (4.24 acres to create three parcels Outlots A, B, C to attach to existing lots of Keyes Addition), Janesville Twp, Sec 22, for Roy and Sally Keyes.   Motion carried unanimously.   Bob Burns and Roy Keyes were also present. 

 

            The second preliminary plat of Roy and Sally Keyes RBK was reviewed by the planning commission and was tabled.  The DNR will view the site before any decision is made.

 

            Angie Knish, Planning & Zoning Administrator, presented a draft request for proposals to re-write the zoning ordinance needed to comply with the passage of the comprehensive plan.  She updated the board on upcoming training and meetings concerning Planning and Zoning. 

 

Bob Burns requested time with the board.  The board informed him he is not on the agenda and suggested taking the matter to the Planning & Zoning Administrator. 

 

Bruce Boyce reviewed the Draft RFP for an employee classification and compensation study.  The board commented on certain points in the RFP.  He will return with a second draft at the next meeting.

 

Bruce asked if the board had any State auditor mandate reform topics to act on and submit to the State Auditor.  He would like to bring any proposed resolutions to the board on March 21st.  

 

Armstrong moved and Ruhland seconded the motion to adjourn the meeting at 11:40 a.m.  Motion carried unanimously.

1c.       After working for one week as a ½ time Office Support Specialist in Human Services, Sheri Dardis decided that she was unable to return to work at this time and submitted a letter of resignation.  In it she expressed her thanks for the opportunities and support that have been given to her by Waseca County.   The position will again be posted within the County and then recruited outside if there are no internal applicants.

 

1d.       Due to the number of changes enacted to our flexible benefits plan during recent years it becomes necessary to do a complete “amendment and restatement’ of the entire plan.  This will incorporate all conditions of the plan into one document which will be provided to all current and new employees.  The resolution below reflects this:

The undersigned, Joan Manthe, serving as Clerk of Waseca County (the “Employer”), duly organized and existing under the laws of the State of  Minnesota, does hereby certify that a meeting of the Commissioners held on the 21st day of March, 2006, at which a quorum was present, the Commissioners unanimously approved the following amendment to the Waseca County Flexible Benefit Plan, (the “Plan”).

 

That the following is a true and correct copy of said Resolution:

 

WHEREAS, the Waseca County previously adopted the Waseca County Flexible Benefit Plan on January 1, 1991;

 

WHEREAS, Waseca County desires to amend the Plan in the following manner:

·        The Plan desires to amend and restate the Plan to incorporate all previous Material Modifications and all applicable regulatory changes since the last amendment and restatement of the Plan, which was January 1, 2003.

 

NOW, THEREFORE, BE IT RESOLVED, that the Waseca County Flexible Benefit Plan be amended effective as of April 1, 2006;

 

BE IT FURTHER RESOLVED, that any authorized persons of the Employer are hereby authorized to make such contributions from the funds of the Employer as are necessary to carry out the provisions of said plan at any time; and

 

BE IT FURTHER RESOLVED, that in the event any conflict arises between the provisions of said Plan and the Employee Retirement Income Security Act of 1974 (ERISA) or any other applicable law or regulation (as such law or regulation may be interpreted or amended), the Company shall resolve such conflict in a manner which complies with ERISA or such law or regulation.

1e.       Commissioner. Androli learned that the HOME Rental Rehabilitation Program proposed by the SW MN Housing Partnership was not presently available through MVAC and would be beneficial to the County, provided that area service providers and contractors would be used as much as possible. The resolution below reflects this:

 

 

RESOLUTION OF COUNTY BOARD

 

WASECA COUNTY, MINNESOTA

 

 

            WHEREAS, the County of Waseca desires to participate in the Minnesota Housing Finance Agency, HOME Rental Rehabilitation Program, and administer it in accordance with all applicable State and Federal regulations; and

 

            WHEREAS, in order to participate in the program it is necessary for the County of Waseca to file an application signed by the Southwest Minnesota Housing Partnership, Executive Director with the Minnesota Housing Finance Agency; and

 

            WHEREAS, the Waseca County Board is required to approve the submission of Application for Administrative Authority; and

 

            WHEREAS, the Waseca County Board desires to participate in the HOME Rental Rehabilitation Program provided that it will be administered with the greatest possible use of local service providers and contractors; and

 

            NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of Waseca County, that the Southwest Minnesota Housing Partnership, Executive Director, is authorized to:

 

            1.  file an Application for Administrative Authority with the Minnesota Housing

Finance Agency for participation in the HOME Rental Rehabilitation  

Program; and

 

2.  administer through the Southwest Minnesota Housing Partnership program 

     funds awarded by the Minnesota Housing Finance Agency for the

     rehabilitation of rental property in the County of Waseca.
