WASECA COUNTY BOARD OF COMMISSIONERS—SEPTEMBER 5, 2006

 

            The Waseca County Board of Commissioners met in regular session on Tuesday, September 5, 2006 in the Commissioner’s Room, East Annex, 300 N. State St., Waseca, Minnesota.  The following members were present:  Rick Morris, Chairperson; Richard Androli, Wendell Armstrong, Jim Peterson and Al Ruhland.

 

            Also present were Marvin Guse, Bob Burns, Charlie Born, Robert and Carol Androli, Roger Androli, residents; Mickey Tibbets, News Reporter; Joan Manthe, Auditor and Bruce Boyce, Coordinator; and other interested persons.

 

            Rick Morris, Chairperson, called the meeting to order at 9:00a.m.  The Pledge of Allegiance was recited.

 

            Androli moved and Armstrong seconded the motion to approve the agenda as presented.  Motion carried unanimously. 

 

            The commissioners reported on meetings attended. 

 

             Ruhland moved and Androli seconded the motion to approve the consent agenda as follows:  Motion carried unanimously. 

1.      Approval of August 15, 2006 minutes.

2.      Approval of Commissioner, Human Services, Auditor and expense bills as presented.

3.      Approve recruitment of part time case aide, and part time Social Worker

4.      Approve Fiscal agent request for Lakes Association to apply for grant

5.      Approve ditch repairs on CD 15-2, 45 and JD 10.

 

Angie Knish, Planning & Zoning Administrator, explained the status of the Coon/Pfiefer residence in Iosco township. Richard Androli stepped down and sat in the audience for this matter.   Robert Androli has asked several questions in a letter about his incomplete permit application for a hog finishing barn.  Angie Knish has answered the questions in a lengthy letter.  One question was asking why a refund was never received for the permit that was not issued for his feedlot.  Ruhland moved and Armstrong seconded the motion to refund $120.54 for the permit application due to extenuating circumstances.  Androli abstained from the motion and the motion was carried. 

 

The next question from Robert Androli had to do with an issue on the Doris Berger property.  The board was okay with the Planning and Zoning Administrator writing the resident to question the size of the structure placed on the property without a zoning permit.  

 

The third question from Robert Androli was “What is meant by completed?”  Androli stated that his rights were taken away because someone else’s property was used for the building for the residence, and that’s not right.  Our zoning ordinance allows one residence in each quarter section.  Under the new comprehensive plan, the density issue needs to be addressed.   Bob Burns and Charlie Born voiced disagreement about the “complete” issue.  Rick Morris said again that the ordinance will be dealt with during the re-write of the ordinance.  Richard Androli returned to the board.

 

Jesse James and Sarah Prescher requested a waiver of double fee for the construction of a 12’ x 20’ deck.  Armstrong moved and Androli seconded the motion to approve a waiver of the double fee for the permit.  Motion carried unanimously. 

 

A request from Andrea Zabawa Bialczak for an extension of a septic system permit in Byron Township has been received.  Androli moved to extend the septic system permit for one year.  Ruhland seconded the motion and it was carried by the unanimous vote of all members.

 

John Malterer was present and has requested credit on the Ag BMP loan.   Armstrong moved and Androli seconded the motion to credit Mr. Malterer $10,000 for the lifetime history purpose under the conditions of the Ag BMP loan program.   Motion carried unanimously. 

 

Discussion began for the hiring of the consultant for ordinance revisions.  The interviews are complete.  The board now is charged with the decision of choosing a vendor to draft a new zoning ordinance.  Armstrong moved to hire URS for the re-write of the zoning ordinance revisions.  Morris seconded the motion.  The following roll call was taken:  Armstrong, yes; Androli, no; Peterson, no; Ruhland, no; and Morris, yes.  Motion failed.  Androli moved to award the bid to Region 9.  Ruhland seconded the motion.  Androli then withdrew the motion.  He would like to be able to visit further with Region 9 at the board meeting in September.

 

Planning and Zoning Administrative review.  Bruce Boyce commented that the labor relations committee meeting felt that a closed session of the county board be held on the 19th day of September to discuss expectations and plans for the office.

 

Angie Knish, Planning & Zoning Administrator, commented on the EAW process on the ethanol plant.  It will not be complete until late this fall.  The county is not able to issue any permits, as the law states, so no construction can begin until permits are issued. 

 

I & S Engineers were present to discuss the new proposed county building.  Also present were Kris Busse, City of Waseca Administrator; Mark Leiferman, Community Development Director; Marilee Reck, Human Services Director;   Tim and Rick from I & S, and Paul Dressler, County Attorney.  They presented a drawing and a price quote of the third floor building on the Brattrud site.  The concern for parking continues.    Commissioner Peterson left the meeting at 11:30.  Further discussion on the building will continue on September 19th. 

 

Nathan Richman, Highway Engineer presented a resolution supporting corridor width.  Ruhland moved and Androli seconded the motion to adopt the following resolution.  It was carried by unanimous vote of all members present.

 

RESOLUTION

REQUESTING A VARIANCE FROM MINNESOTA RULES

FOR STATE AID OPERATIONS 8820.2500, MINIMUM STATE AID STANDARDS

 

            WHEREAS, the Waseca County Board is the official governing body of Waseca County; and

            WHEREAS, Pursuant to Minnesota Rules 8820.3300, a political subdivision may formally request a variance from the State Aid standards; and

            WHEREAS, the Clear Lake Drive road reconstruction and trail project SAP 81-613-05, SAP 81-604-21, SP 81-090-03, and SP 81-090-04, located in Waseca and Woodville Township around the perimeter of Clear Lake, will be constructed beginning in the summer of 2007, and will provide a reconstructed road and an off road bike and pedestrian path; and

            WHEREAS, the entire project will be built to State Aid Standards excepting that some of the right of way corridor outside the Waseca City limits is 60’; and

            WHEREAS, the typical roadway section for the 2.646 mile reconstruction project is an urban section with curb and gutter; and

            WHEREAS, the right of way corridor in the Waseca City limits meets the minimum State Aid Standards of 8820.2500 Subpart 3; and

            WHEREAS, the right of way corridor outside the Waseca City limits is 60’ wide for 0.910 miles of the 1.695 miles; and

            WHEREAS, due to practical limitations it is not feasible to purchase a 66’ right of way corridor in all locations in the rural area; and

            WHEREAS, this project will not be eligible for federal or state aid funds unless the project is constructed to the minimum right of way corridor State Aid Standard of 60’ in cities and 66’ in the rural area; or a variance is granted; and

            NOW THEREFORE BE IT RESOLVED, that the Waseca County Board of Commissioners hereby requests the Commissioner of Transportation to grant a variance authorizing a 60’ wide corridor between Station 133+25 and 166+00 and between Station 179+85 and 195+15 in lieu of the minimum 66’ right of way width required by Minnesota Rules for State Aid Operations 8820.2500.

            BE IT FURTHER RESOLVED, that the Waseca County Board hereby indemnifies, saves, and holds harmless the State and its agents and employees of and from claims, demands, actions, or causes of action arising out of or by reason of the granting of the this variance.

 

Nathan reported on the Evergreen Land Services Company proposal.  The number of parcels has increased since approval of the contract and he is requesting a new contract showing the increase in parcels around Clear Lake Trail.  Armstrong moved and Ruhland seconded to authorize the highway engineer to sign the contract with Evergreen Land Services Company for fifty-four properties in an amount not to exceed $207,230.00.   Motion carried unanimously. 

 

Nathan requested support for the right of way permit concept to allow the landowner to do some work in the right of way at landowner expense.   Armstrong moved and Androli seconded motion to support the application for right of way permit process.  Motion carried unanimously. 

 

Nathan Richman recommended that Waseca County continue to move forward with the road safety audit recommendations for the Clear Lake Trail project.  He presented a letter from Bonestroo Rosene Anderlik & Associates for a proposal for preparation of an Environmental Assessment Worksheet on Clear Lake Trail.  Ruhland moved and Armstrong seconded the motion to authorize the Chairman of the Board to sign the agreement with Bonestroo Rosene Anderlik & Associates for collecting and analyzing the information pertinent to the project and prepare the EAW needed to continue.  Motion carried by unanimous vote.

 

Bruce Boyce, Coordinator, presented a summary of neighboring counties percentage of increase.  Waseca County is proposing a 9.3% increase for 2007 tax levy.  The board asked some questions on certain proposed items.  The budget and levy will be adopted for Truth in Taxation purposes at a special board meeting to be held on September 12, 2006.

 

Rick Morris moved to direct the County Attorney’s office to draft a notice of sale to list the county property located on CSAH 4.  Androli seconded the motion.  The motion failed by the following roll call:  Armstrong, no; Androli, yes; Ruhland, no and Morris, yes.

 

Armstrong moved and Androli seconded the motion to adjourn the meeting at 12:30 p.m.  Motion carried unanimously.
