Rick
Morris, Chairperson, called the meeting to order at
Androli moved and Armstrong seconded the motion to approve the agenda as presented. Motion carried unanimously.
The commissioners reported on meetings attended.
Ruhland moved and Androli seconded the motion to approve the consent agenda as follows: Motion carried unanimously.

The next question from Robert Androli had to do with an issue on the Doris Berger property. The board was okay with the Planning and Zoning Administrator writing the resident to question the size of the structure placed on the property without a zoning permit.
The third question from Robert
Androli was “What is meant by completed?”
Androli stated that his rights were taken away because someone else’s
property was used for the building for the residence, and that’s not
right. Our zoning ordinance allows one
residence in each quarter section. Under
the new comprehensive plan, the density issue needs to be addressed. Bob Burns and Charlie Born voiced
disagreement about the “complete” issue.
Rick Morris said again that the ordinance will be dealt with during the
re-write of the ordinance.
Jesse James and Sarah Prescher requested a waiver of double fee for the construction of a 12’ x 20’ deck. Armstrong moved and Androli seconded the motion to approve a waiver of the double fee for the permit. Motion carried unanimously.
A request from Andrea Zabawa Bialczak for an extension
of a septic system permit in
John Malterer was present and has requested credit on the Ag BMP loan. Armstrong moved and Androli seconded the motion to credit Mr. Malterer $10,000 for the lifetime history purpose under the conditions of the Ag BMP loan program. Motion carried unanimously.
Discussion began for the hiring of the consultant for ordinance revisions. The interviews are complete. The board now is charged with the decision of choosing a vendor to draft a new zoning ordinance. Armstrong moved to hire URS for the re-write of the zoning ordinance revisions. Morris seconded the motion. The following roll call was taken: Armstrong, yes; Androli, no; Peterson, no; Ruhland, no; and Morris, yes. Motion failed. Androli moved to award the bid to Region 9. Ruhland seconded the motion. Androli then withdrew the motion. He would like to be able to visit further with Region 9 at the board meeting in September.

RESOLUTION
REQUESTING A VARIANCE FROM
FOR STATE AID OPERATIONS 8820.2500,
WHEREAS,
the Waseca County Board is the official governing body of
WHEREAS, Pursuant to Minnesota Rules 8820.3300, a political subdivision may formally request a variance from the State Aid standards; and
WHEREAS, the Clear Lake Drive road reconstruction and trail project SAP 81-613-05, SAP 81-604-21, SP 81-090-03, and SP 81-090-04, located in Waseca and Woodville Township around the perimeter of Clear Lake, will be constructed beginning in the summer of 2007, and will provide a reconstructed road and an off road bike and pedestrian path; and
WHEREAS, the entire project will be built to State Aid Standards excepting that some of the right of way corridor outside the Waseca City limits is 60’; and
WHEREAS, the typical roadway section for the 2.646 mile reconstruction project is
an urban section with curb and gutter; and
WHEREAS, the right of way corridor in the Waseca City limits meets the minimum State Aid Standards of 8820.2500 Subpart 3; and
WHEREAS, the right of way corridor outside the Waseca City limits is 60’ wide for 0.910 miles of the 1.695 miles; and
WHEREAS, due to practical limitations it is not feasible to purchase a 66’ right of way corridor in all locations in the rural area; and
WHEREAS, this project will not be eligible for federal or state aid funds unless the project is constructed to the minimum right of way corridor State Aid Standard of 60’ in cities and 66’ in the rural area; or a variance is granted; and
NOW
THEREFORE BE IT RESOLVED, that the Waseca County Board of
BE IT FURTHER RESOLVED, that the Waseca County Board hereby indemnifies, saves, and holds harmless the State and its agents and employees of and from claims, demands, actions, or causes of action arising out of or by reason of the granting of the this variance.
Nathan reported on the Evergreen Land Services Company proposal. The number of parcels has increased since approval of the contract and he is requesting a new contract showing the increase in parcels around Clear Lake Trail. Armstrong moved and Ruhland seconded to authorize the highway engineer to sign the contract with Evergreen Land Services Company for fifty-four properties in an amount not to exceed $207,230.00. Motion carried unanimously.
Nathan requested support for the right of way permit concept to allow the landowner to do some work in the right of way at landowner expense. Armstrong moved and Androli seconded motion to support the application for right of way permit process. Motion carried unanimously.
