The Waseca County Board of
Commissioners met in regular session on Tuesday, October 17, 2006, at 9:00 a.m.
in the Commissioner’s Room, East Annex, 300 N. State St., Waseca,
Minnesota. The following members were
present: Rick Morris, Chairperson;
Richard Androli, Wendell Armstrong, and Jim Peterson. Al Ruhland was absent.
Also present were Bruce Boyce,
Coordinator; Joan Manthe, Auditor; Cheri Lewer, Public Health Director; Laura Young,
Family Health Services Director;
Judy Hiller, Information Technology Director; and Bob Breck, Maintenance
Supervisor.
Rick Morris, Chairperson, called the
meeting to order at 9:00 a.m. The Pledge
of Allegiance was recited.
Armstrong moved and Peterson
seconded the motion to approve the agenda as presented. Motion carried unanimously.
The commissioners reported on
meetings attended.
Androli moved and Armstrong seconded the
motion and by unanimous vote of all members moved to approve the consent agenda
as follows:

Purchase
of Services Agreement for Elderly Waiver and Alternative Care Program
The
following is a list of home care providers for which Public Health would like
to purchase services for clients who are eligible for the Elderly Waiver or
Alternative Care Program. The Agreements
are in effect from 10/01/06 to 09/30/07.
The rates listed in the Agreements are in accordance with the rates set
by State of Minnesota, Department of Human Services. In the past, we have had Agreements with
seven providers and this year we will be adding an additional seven

Cheri
Lewer and Judy Hiller explained the phone and computer capability at the Public
Health building with the added staff. A
solution for the overload is to use wireless computer connections. Whitewater Wireless has given a quote of
$5095.60 for this enhancement. Androli
moved and Armstrong seconded the motion to approve purchasing the setup and
installation of wireless computer connection of $5,095.60 to the Public Health Building. Motion carried unanimously.
Cheri
Lewer presented a plan for temporary office space for added staff. A mobile trailer unit can be obtained for lease from Hilltop Trailer Sales in
Mankato for a 12’ x 46’ unit to lease for 1 year for $6,800.00 Armstrong moved and Androli seconded the
motion to lease the 12’ x 46’ unit from Hilltop Trailer Sales for $6800 a year
plus tax for at least a two year period.
Motion carried unanimously.
The
public hearing for Highway 14 address change
began at 9:40 a.m. Angie Knish
informed the public that forty-two notices were sent to all landowners on U.S.
Highway 14 from each county line. The
new address will be called Old Highway 14 and be used for 911 emergency
services addressing and mail delivery.
Brad Milbrath, Deputy Sheriff, was also present and stated the name is
the same as what Blue Earth County is using, therefore providing consistency
for emergencies. Armstrong moved and
Androli seconded the motion to rename the U.S. Highway 14 addresses to Old
Highway 14. The nine individual
addresses along Highway 14 from west county line to Waseca will take effect as
of October 17, 2006. Motion carried
unanimously. The other addresses will
take effect when state road construction by that residence is complete.
A
conditional use permit was received from Kathy Delarosa for a continued use of
existing structure as mixed use: used
auto sales and residential is existing no-conforming, single family dwelling,
DBA DLR Auto Sales in Section 16, Woodville Township. Armstrong moved and Androli seconded the
motion to approve the CUP with the following 13 conditions. Motion carried unanimously.
1. All chemicals,
hazardous materials, waste, and nutrients and/or etc. shall be properly used or
disposed of by legal, environmentally sound methods. Any spills resulting
from the use of such chemicals, hazardous materials and etc shall be properly
reported, contained and mitigated as the Minnesota Pollution control agency may
deem necessary. The State Duty Officer phone number is 1-800-422-0798;
and
2. The area shall be
kept neat and clean and shall not constitute a nuisance or be kept unsightly,
and
3. An erosion
control plan shall be implemented during any construction period to prevent
soil erosion during all construction phases upon the property; and
4. Trees and natural
vegetation shall be maintained and or left undisturbed to maintain a natural
landscape, to prevent soil erosion. Any alterations to the Outlots shall
be under the guidance of the Soil and Water Conservation District
(wetland conservation act authority), the Waseca County Zoning Office
(shoreland regulation authority) and the Department of Natural Resource (DNR)
Shoreland Regulations; and
5. The County Board
shall reserve the right to impose additional restrictions or conditions to the
issuance of a Conditional Use Permit, as it deems necessary to protect the
public interest. These conditions or restrictions may include matters
relating to appearance, lighting, hours of operation and performance
characteristics. Restrictive covenants may be entered into
regarding such matters, when appropriate, and
6. A Conditional Use
Permit shall become void one (1) year after being granted by the County Board
unless used or if discontinued for a period of ninety (90) days. The
County Board may prescribe a different time limit within which the action for
which the Conditional Use is required shall commence, or be completed, or
both. Failure to commence, or complete, or both, such action within the
time limit set shall void the Conditional Use Permit, and
7. A Conditional Use
Permit shall be issued for a particular use on a specific parcel and not for a
particular person or firm, and
8. Any other
specific conditions the planning commission or Board of Commissioner’s deem
necessary to protect the health, safety, comfort, morals, or general welfare of
the public at any time in the future, and
9. Failure to comply
with any of the above-listed conditions shall be grounds for suspension or
revocation of the Conditional Use Permit; and
10. The owner/operator/applicant shall
maintain/obtain enough land so as not to exceed 25% impervious surface of the
entire parcel; and
11.
On-site water supply and sewage treatment systems shall meet or exceed MN Rules
7080 and Waseca County ISTS Ordinance(s).
12.
Wetlands: Wetlands are
protected by Minnesota Statute. No lot owner shall conduct any activity
within the wetland without prior authorization from the Local Unit of Government
(currently the SWCD). A permanent post shall be erected at the lot lines
of each lot, at the wetland delineation line to insure the protection of the
wetlands; and
13.
Shoreland Overlay Zone regulations shall apply to this request; this shall
include development standards, shoreland alteration standards, including
grading and filling. Please contact your local zoning office for a
complete copy of applicable regulations.
Angie
Knish presented Interim Ordinance #84 and explained this ordinance addresses
the sequencing of zoning requests, particularly when two competing interests
may be attempting to locate in the same vicinity, such as, but not limited to
feedlots, residences and/or subdivisions.
The Planning Commission has found that the interim ordinance has merit
to become a permanent ordinance. A
public hearing was held by the Planning Commission on Oct 5th and
voted to adopt the ordinance as a permanent ordinance. Armstrong introduced the following
resolution and moved for its adoption.
Peterson seconded the motion to approve the Interim Ordinance 84 as a
permanent ordinance and rename the Permanent Ordinance to Number 91. Motion
carried unanimously.
Resolution
Whereas,
Waseca County Zoning Ordinance No. 75, Section 22, sets for the requirements
and process for amendments and rezoning, and
Whereas, The County Board may by
ordinance, amend, or add to the regulations of this Ordinance, whenever the
public necessity, convenience, general welfare or good land use policy require
such amendment, in accord with the applicable provision of Minnesota Statutes
394.21 through 394.36, and
Whereas, The following proposed
zoning ordinance amendments were reviewed by the Waseca County Planning
Commission, proper public notice was given by public newspaper of time and
place, a public meeting was held, and the Board of Commissioners granted
approval of the following requests (see the table below); and
Whereas, MN Statutes, 375 requires
that every county ordinance shall be enacted by a majority vote of all members
of the County Board unless a larger number is required by law; and
Whereas MN Statute 375, requires
that every county ordinance shall be signed by the chair of the board and
attested by the clerk of the board; and
Whereas, proof of the publication
shall be attached to and filed with the ordinance in the Office of the County
Auditor; and
Whereas, every ordinance shall be
recorded in an ordinance book in the office of the County Auditor within 20
days after its publication; and
Whereas, a notice of intention to
enact an ordinance shall be published in the official newspaper of the county
not less than 10 days before the meeting or public hearing required. Public hearings may be continued from time to
time and additional hearings may be held.
Proof of the public notice shall be filed with the ordinance, if enacted,
in the office of the county auditor.
Whereas, the official zoning map is
required to be updated and to reflect any zoning district change by Ordinance
and;
Whereas, every ordinance enacted by
the county board shall be published at least once as part of the proceedings of
the meeting at which the ordinance was enacted.
Publication shall be made in the official newspaper of the county but
additional publications, either in the official newspaper or other newspaper
may be ordered; and
Whereas, the County Board approved
the Zoning Amendment of Zoning Ordinance No. 91 as attached; and
Now therefore be it resolved that the County Board enacted Waseca County
Ordinance No. 91. at their regularly
scheduled Board meeting of October 17, 2006.
This
Ordinance shall become effective this 17th day of October by the
order of the Waseca County Board of Commissioners.

ZONING PERMIT
PROCESSING
THE
WASECA COUNTY BOARD OF COMMISSIONERS ORDAINS;
Whereas,
Waseca County Zoning Ordinances allow for land uses which have setbacks from
other land uses, and
Whereas,
in some cases, those land uses may require reciprocal setbacks from each other;
and
Whereas,
setbacks are measured from the physical presence of one entity to another; and
Whereas,
when the ordinance was written it was expected that one entity would be present
and the proposed entity could be established at the required setback distance
from the existing entity; and
Whereas,
Waseca County has found through occurrence, that two or more landowners can
request permits for a land uses simultaneously for the same geographical area
where no entity currently exists, and
Whereas,
two or more zoning permits can be issued for the same geographical area, it is
the establishment of the first entity which determines where the following
entities must be located; and
Whereas,
a landowner who has made application may have an investment of time, money,
effort and planning, which may be lost by one individual to another; creating
conflict, financial loss and emotional distress, and
Whereas,
the Planning Commission has been directed by the County Board to review the
issues precipitating this matter, and
SECTION
1 PURPOSE
The
purpose of this Ordinance is to protect the right of a landowner, who in
good-faith has submitted a completed application to the Waseca County Zoning
Office for a particular land use project within a particular geographic
area. It is also to ensure that
applicant the appropriate time to complete his/her application process without
interruption from a competing land use request in the same local area.
SECTION 2 AUTHORITY
This Ordinance is hereby adopted pursuant to the authority of Minnesota Statute 394.
SECTION
3 APPLICATIONS AND PERMITS
This
Ordinance hereby amends the Waseca County Zoning Ordinance No. 75, Waseca
County Feedlot Ordinance No. 76, and Waseca County Subdivision Ordinance No.
43, to the limited extent and purpose of establishing a priority for the
receipt of applications and issuance of permits for feedlots, residences and
subdivisions. Except as modified by this
Ordinance the above-listed ordinance shall remain in full force and
effect. This Ordinance replaces and
rescinds Interim Ordinance No. 84.
All
applications and permits shall be processed as follows:
1)
Upon
receipt of a completed application (when one exists) or a formal written notice
of a process to proceed (when an application does not formally exist) for a
process that is required by Federal, State or local Statutes, Rules or
Ordinance, the written documents shall be submitted to Waseca County Zoning
Office. The person making application or
formal written notice shall be deemed as “Applicant A”.
2)
“Applicant
A’s” request, as noted above, shall be reviewed for completeness.
a)
If
Applicant A’s application is complete it shall be accepted by the Zoning Office
and shall proceed through the appropriate process as required. If the application is complete, it shall be
deemed “accepted.”
b)
If
Applicant A’s application is incomplete, it shall be returned to the applicant
by first class mail and shall include a written statement informing the applicant
of the information that is missing or incomplete. The application shall not be deemed “not
accepted”.
3)
During
the process of review, an “accepted” application from “Applicant A” may be
required to submit additional information to the requesting government entity
in order to complete the process and/or make a decision on behalf of a request,
such as, but not limited to, requestes from the planning commission or board of
commissioners during a conditional use permit, subdivision and plat, or from
the environmental review authority. All
information shall be provided in a timely manner.
4)
An
applicant must complete the following process in the time periods listed below
to protect the applicant’s developmental rights.
|
Animal
feedlot: 10 AU – 49 AU
|
Within
30 days of receipt of a completed feedlot registration an applicant shall
establish a feedlot by definition or submit a completed zoning application
for a structure.
As
per Zoning Ordinance; a structure shall be completed within one (1) year of
issuance of the Zoning Permit.
|
|
Animal
feedlot: 50 AU- 999 AU
|
Within
90 days following the site team inspection or conditional use permit
decision, the appropriate completed feedlot permit application shall be
submitted to the Zoning Office.
Within
30 days of issuance of a feedlot permit by the County Feedlot Officer, a
completed application for a zoning permit to construct an animal feedlot
structure shall be submitted to the Zoning Office.
As
per Zoning Ordinance; a structure shall be completed within one (1) year of
issuance of the Zoning Permit.

|
Animal
feedlot: > 1000 AU
|
A
feedlot required to complete an environmental review shall notify the zoning
office in writing at the time of submission to the MPCA.
Within
30 days of the completion of the environmental review the applicant shall
submit an application for site team or conditional use process.
Within
90 days following the site team inspection or conditional use permit
decision, the appropriate completed feedlot permit application shall be
submitted to the Minnesota Pollution Control Agency.
Within
30 days of issuance of a feedlot permit by the Minnesota Pollution Control
Agency, a completed application for a zoning permit to construct an animal
feedlot structure shall be submitted to the Zoning Office.
As
per Zoning Ordinance, a structure shall be completed within one (1) year of
issuance of the Zoning Permit.

|
Residential
Subdivision and Plat; as
approved by the County Board:
|
Setbacks:
Any setback shall be calculated from the buildable area of a lot until a
residential structure is physically located upon the lot(s).
|
|
Residential
Subdivision and Plat;
application process:
|
The
pre-application meeting, as required by Subd. 4.02 of the Subdivision
Ordinance, shall be held at the next regularly scheduled meeting of the
planning commission. The applicant
shall define a specific area of the potential subdivision.
A
preliminary plat and completed application shall be received by the zoning
office within 60 days of the pre-application meeting of the planning
commission.

|
*Residence,
permitted use:
|
As
per Zoning Ordinance, the structure shall be completed within one (1) year of
issuance of the Zoning Permit.
|
|
*Residence,
by Conditional Use Permit
|
A
completed application for a zoning permit shall be submitted within 90 days
of County Board Approval of the Conditional Use Permit.
As
per Zoning Ordinance, the structure shall be completed within one (1) year of
issuance of the Zoning Permit.
|
|
Sale
of land
|
Waseca
County shall not warranty land for development that has not proceeded through
the appropriate processes and received proper approvals of the County Board, Zoning
Administrator, or Board of Adjustment, as may be required.
|
(*) Completion of a residential structure
shall include all of the following:
(1) Construction of walls and roof;
placement of windows and doors.
(2) An approved, constructed, and
functioning waste disposal system, IE ISTS, public sewer, etc.
(3) Electricity, a heating source and water
supply.
(4)
The structure in general shall be
in habitable form. An unfinished
basement is acceptable. “In general”
habitable form includes such things as, internal
walls,
flooring, ceiling, cabinetry, plumbing, toilet and bath fixtures.
Should
a landowner not be timely in his/her application process “Applicant A” shall
forfeit the exclusive right of zoning review to the immediately following
applicant for a land use request within the same geographical area.
Should
a second applicant, deemed, “Applicant B” make application for a land use which
is allowed in the same geographical vicinity the following policy shall apply:
a)
If
“Applicant A” has followed the processes and procedures as listed above, “Applicant
A’s” project shall be considered “active and on-going” and shall be exclusively
considered by Waseca County for processing.
b)
No
other application shall be considered within a specified setback boundary, as
established by any Waseca County Ordinance, of “Applicant A’s” proposed
project.
c)
Upon
receipt of any additional applications that have followed the procedures as
listed above; any second or additional applicants shall be notified in writing
by the Waseca County Zoning Office of a pending “active and on-going”
application that is being considered.
Each
application shall be marked with the date and time of submittal to the zoning
office to determine the order of consideration.
Applications or formal written notices, (when an application does not
formally exist) received by mail shall be considered received at 10:30 a.m.
upon their day of receipt.
If
more than one application or formal written notice is received upon the same
day and time, the order of consideration shall be determined by the Waseca
County Board of Commissioners.
Each
additional application or formal written notice (when an application does not
formally exist) to “Applicant A’s” request shall be “denied” by the Waseca
County Zoning Administrator until such time that:
a)
The
necessary processes have been completed by “Applicant A” and the land use
entity exists and therefore the second or following request(s) can not meet the
standards of the ordinance and an application would administratively be denied;
or
b)
“Applicant
A” withdraws and rescinds his/her application in writing; or
c)
“Applicant
A” fails to complete the necessary process to completion in the above specified
time frame.
Upon
the withdrawal of “Applicant A’s” request, upon “Applicant A’s “ failure to act
in a timely manner, or upon the denial of “Applicant A’s” request; then
“Applicant B’s” request shall move forward and be considered for approval
through the same processes as was afforded “Applicant A”. “Applicant B” shall have 14 calendar days
after written notice by the Waseca County Zoning Office to notify the Waseca
County Zoning Office if they would like their application or formal process
placed into “active and ongoing” status.
.
Should
“Applicant B” respond within 14 calendar days that they wish to have their
completed application considered; they shall be subject to the same processes
of “Applicant A”. Additional applicants
shall be treated in the same manner when more than one additional applicant
exists. IE: When applicant B moves to active and on-going
status, “Applicant C’s” request shall be considered “on-deck”.
Should
“Applicant B” decline the opportunity to move forward or not respond to the
written notice of the Waseca County Zoning Office; “Applicant C”, if there is
one, shall be notified of such opportunity to be moved to “active and ongoing”
status.
Any
additional applicants shall be subject to the same process as Applicant B. Each additional applicant shall be considered
in the order the application or formal notice of process is received. Nothing in this Ordinance prevents a previous
applicant from reapplying and repeating the process that may have been
previously denied, withdrawn, or was previously lost by failure to respond or
provide information.
The
Waseca County Zoning Office shall be responsible to make the applicant aware of
the timelines the applicant is subject to in writing.
SECTION
4 EFFECTIVE DATE:
This
Ordinance shall become effective this 17th day of October by the
order of the Waseca County Board of Commissioners.
Nathan
Richman, Highway Engineer, presented the request for a stop sign at a location in
New Richland. Peterson introduced the
following resolution and moved for its adoption. Androli seconded the motion and it was passed
by the unanimous vote of all members present.
RESOLUTION
NOW THEREFORE, BE IT RESOLVED, by
the Waseca County Board of Commissioners that the following regulatory sign be
added.
At
County State Aid Highway 12 and NW Seventh St. in New Richland. This is in New Richland’s Homestake Addition
on NW Seventh approaching CSAH 12.
A
master contract for county services to allow for road maintenance on Old
Highway 14 was presented by Richman.
Androli introduced the resolution and Armstrong seconded the
motion. The resolution was adopted by
unanimous vote.
RESOLUTION
WHEREAS, The Minnesota Department of
Transportation wishes to cooperate closely with local units of government to
coordinate the delivery of transportation services and maximize the efficient
delivery of such services at all levels of governments; and
WHEREAS, occasionally opportunities
arise for local governments to provide services to MnDOT and
WHEREAS, the parties wish to be able
to respond quickly and efficiently to such opportunites for collaboration, and
have determined that MnDOT having the ability to write work orders against a
master contract would provide the greatest flexibility; and
THEREFORE BE IT RESOLVED,
1.
That
the County of Waseca enters into the “State of Minnesota Professional and
Technical Services Master Contract” with the Minnesota Department of
Transportation.
2.
That the proper County officers are authorized
to execute such contract and any amendments thereto.
3.
That the County Engineer is authorized to
negotiate work order contracts pursuant to the Master Contract, which work
order contracts, will provide for payment of County by MnDOT, and that the
County Engineer may execute such work order contract on behalf of the County
without further approval by this Board.
Nathan
updated the board on Clear Lake Drive/Trail.
The EAW worksheet is ongoing. The
county is following the guidelines laid out in MN Statutes 4410.300. The EAW process is ongoing.
Paul
Dressler, County Attorney; Kris Busse, Waseca City Administrator; and Fred
Salisbury, City Engineer were present for the discussion of 375th
Ave. Possible options in changing the
road authority of 375th Ave were discussed, but no action was taken
at this time.
Bruce
Boyce, Coordinator, talked to the board about the financing of the Human
Services building. Also discussed were
issues in constructing a new building and helping the architect in drawing a
plan. Bruce will assemble a list of
revised commissioner issues and discuss it again at the next meeting.
Armstrong moved and Androli seconded
the motion to accept the veterans report.
Motion carried unanimously.

moved and Androli seconded the motion to adjourn the meeting at 12:00
noon.
