The Office of County Recorder, formerly called Register of Deeds, was
established by the Territorial Legislature as a depository for land records. At this time
all land records were filed under the abstract system. The Minnesota Legislature enacted a
statute in 1901 allowing registration of land in counties with over 75,000 inhabitants. In
1909 the act was amended to include the entire state and Registrar of Titles was added to
our name. District Court controls the registration of land under the Torrens system, and
directs the Registrar as well as appointing an Examiner of Titles as legal advisor.In Waseca County, the County Recorder/Registrar of Titles is an elective office
with a term of four years. We are custodians of all records pertaining to real property in
our county, preserving the past and present for all generations. There are over 200 types
of documents pertaining to real property rights which may be filed in our office. Our land
records begin in 1856 and run through the present. Certificates of Title, conveying land
under the Torrens system, are generated here. There is a fee for recording documents and
for copies of our records which may be obtained by mail or in person.
Personal property records show whether property such as crops,
snowmobiles, machinery, household goods, etc., have been used as collateral for a loan.
These are filed in the Uniform Commercial Code (UCC) system, which is a statewide computer
network. For a fee, lien searches are generated through the computer.
Effective Financing Statements (EFS) and Statutory Lien Notices also are
filed here. These are entered into the statewide Central Notification System (CNS). Buyers
of farm products can purchase access to this system through the Secretary of State's
Office.
Individuals may record their Military Service Discharge here. No fee is
charged for this service. A certified copy from our office can be used in place of the
original.
Oaths of Office, land plats, Federal and State Tax Liens are filed in
the Recorder's Office. Our recorded and filed records are open to the public. |
